Decision

Before the cassation court the first defendant argued that the ruling had erred in the application of law as he had maintained before the court that there was no financial guarantee required for the payment of the dues.

The court held that this argument was invalid as the claimant had the right to receive his dues by the agreed dates regardless of the existence of a financial guarantee.

The court therefore dismissed the appeal.
