KCC 221/2007/1
Background
A claimant filed a case against a defendant and requested the court to dismiss decisions made by the defendant against him.
The court ruled that the decisions should be dismissed.
The defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The defendant appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had insufficient evidence of causation because the ruling had violated the rules of Kuwait Law No. 116/1992.
The court stated this argument was partially invalid because the ruling had complied with the relevant laws except on the wage deduction from the employee for 14/03/2005. This deduction should not considered to be a disciplinary punishment.
The court repealed the ruling partially.
