KCC 199/2007

This case involved compensation and blood money awarded to the heirs of a man who had been killed. The court had been wrong not to have deducted temporary compensation awarded in the criminal ruling from the final amount.

Background

The heirs of a deceased man filed a case against a defendant and requested the court to order the defendant to pay them blood money and compensation. The heirs stated the defendant had killed their father and a criminal ruling had already been issued against him.

The court ruled that the defendant should pay the heirs 10000 Dinars as compensation in addition to 20000 Dinars for blood money.

The heirs and the defendant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had violated the law because the court had not deducted temporary compensation that was stipulated by the criminal ruling from the value of compensation in the current ruling as the heirs could not have both of them.
