KCC 195/2005

This case involved a claim by an employee for pay in lieu of notice when their contract of employment was terminated. This was not due as the employee had a definite period contract which had ended.

Background

An employee made a complaint against a bank and requested the Labour Department to order the bank to pay his dues. The department referred the case to the court.

The court ruled that the bank should pay the employee 108997.320 Dinars.

The bank appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the bank should pay the employee 14689 Dinars.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had insufficient evidence of causation and had contradiction of material documentary evidence because the court had refused to order the bank to pay him pay in lieu of notice although the bank had terminated the contract.
