KCC 183/2007

This case involved a claim by an employee for his dues. The court had been correct to award the employee pay for holidays and Fridays even though they had one day off a week which they did not work.

Background

An employee made a complaint against a company and before the Labour Department and requested the department request the company to pay his dues. The department referred the case to the court.

The court ruled that the company should pay the employee 1236.161 Dinars.

The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 15829.846 Dinars.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law because the court had ruled that the company should pay full wage for holidays and Fridays although the witnesses had confirmed that the employee uses to get one day per week as a rest day.
