KCC 177/2006/1

A case involved a dispute between a claimant and defendant over the payment of his dues.

Background

A claimant filed a case against a defendant requesting that the court order the defendant to pay his dues.

The court rejected the case.

The claimant appealed and the appeal court upheld the ruling.

The claimant appealed by cassation.

Decision

Before the cassation court the claimant argued that the ruling had erred in the application of law and had insufficient evidence of causation as the court had dismissed his right to receive furniture and housing allowances based on him having left government housing before five years, but he was not aware of this stipulation.

The court held that this argument was invalid as the claimant had been granted government housing and he subsequently left the housing. The court stated that furniture allowance was related to housing allowance and thus he had no right to request the two allowances under a Civil Service Council decision.

The court therefore dismissed the appeal.
