KCC 139/2006

A case involved a dispute between a claimant and defendants over the payment of housing allowance.

Background

A claimant filed a case against two defendants requesting that the court order them to pay housing allowance in the amount of 10500 Dinars.

The court ruled that the first defendant pay the claimant the mentioned amount.

The defendants appealed and the appeal court upheld the ruling.

The defendants appealed by cassation.

Decision

Before the cassation court the defendants argued that the ruling had erred in the application of law and had insufficient evidence of causation as they had provided the court with documents confirming the claimant used to live in governmental housing and thus did not deserve the allowance.

The court held that this argument was invalid as the Civil Service Council cancelled the system of governmental housing and granted housing allowance as the alternative.

The court therefore dismissed the appeal.
