KCC 130/2006

This case involved a claim by an employee for unpaid dues. The employee wrong argued there were allowances he was owed. However, these had not been determined by the employee so the court could not award them.

Background

An employee made a complaint against an employer and requested the Labour Department to order the employer to pay his dues. The department referred the case to the court.

The court ruled the employer should pay the employee 10661.390 Dinars.

The employee and the employer appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the employer should pay the employee 7414.524 Dinars.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had contradictions of material documentary evidence because the court had ignored his request to consider other allowances that he deserved.

The court stated this argument was invalid because the request that the court can consider needs to be accurate and certain. The court stated the employee had failed to determine exactly the other allowances he deserved.

The court dismissed the appeal.
