KCC 84/2005
Background
An employee filed a case against an institution requesting that the court order it to pay his salaries.
The court ruled that the institution pay the employee 1706.360 Dinars.
The owner of the institution appealed and the appeal court ruled that the owner pay the employee 938.814 Dinars.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the ruling had erred in the application of law as he had maintained before the court that he deserved severance pay under Article 18 of Kuwait Law No. 28/1969, but the court ignored this defence.
The court stated that this argument was invalid as the court has the authority to consider all aspects of a case and evaluate the evidence before it to establish its ruling.
The court therefore dismissed the appeal.
