KCC 42/2006/1

This case involved a claim by an individual for a General Institution of Social Insurance committee of pleas decision to be rejected. The key issue was whether the appeal deadline had been missed. The claimant stated they had not been informed of the committee decision until the date the appeal deadline started. This argument was invalid because the defence had not been established on a legal basis.

Background

A claimant filed a case against defendants and requested the court to dismiss the decision of the committee of pleas in the General Institution of Social Insurance.

The court rejected the case.

Decision

The claimant appealed the ruling before the court of cassation and stated in her grounds of appeal that the ruling had insufficient evidence of causation and the court had rejected her case based on the argument that she had failed to file it within the legal deadline although the institution did not inform her of the rejection until 28/02/2004, the date in which the plea deadline started.

The court stated this argument was invalid because the defence of the claimant had not been established on a legal basis.

The court dismissed the appeal.
