KCC 368/2006
Background
A claimant filed a case against a defendant and requested the court to appoint an expert in order to calculate the value of his retirement salary and order the defendant to pay accordingly.
The court stated the case was finished.
The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and referred the case to the elementary court that rejected the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The claimant appealed the ruling before the court of cassation.
The court of cassation raised issues which related to the general system because the claimant had filed the case before the department of appeal which referred the case to the civil department in the plenary court and so the ruling could not be appealed independently because it had not settled the dispute.
The court repealed the ruling and referred the case to the court of appeal for reconsideration.
