KCC 268/2005

This case involved a claim for salary and compensation for a workplace injury from an employee. It was wrongly claimed there was no evidence the employee had been injured at work but the court had based its ruling on a medical report that the injury was as a result of working for the company.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay his salary and compensation for a workplace injury. The department referred the case to the court.

The court rejected the case.

The employee appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled that the company should pay the employee 6266.666 Dinars.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had violated the law and had contradictions of material documentary evidence because the court had ruled that the company should compensate the employee although the case documents included no evidence that the employee was injured at work.
