KCC 155/2006

This case involved a claim by an employee for unpaid salary. Additional awards were made for lawyer's fees and the reservation of the employee's passport. Estimating legal fees fell under court authority which impacted whether an appeal could be made.

Background

An employee made a complaint against a company before the Labour Department and requested the department to order the company to pay his salary. The department referred the case to the court.

The court ruled that the company should pay the employee 4524.072 Dinars in addition to 1200 Dinars as compensation for the reservation of his passport and 250 Dinars for the lawyer.

The employee and the company appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay the employee 4623.421 Dinars.
