KCC 999/2005

This case involved a claim for money owed and legal interest for unpaid amounts related to car rental. The key issue was whether legal interest was owed. The rental was classed as a commercial activity and so the debt was a commercial debt.

Background

A claimant filed a case against a company and requested the court to order the company to pay him an amount of money and legal interest. The claimant stated that the company had rented two cars from him and still owed the amount.

The company requested the court to order the claimant to pay compensation as there was an issue with the two cars.

The court ruled that the company should pay the claimant 26000 Dinars. The court rejected the request made by the company.

Decision

The company and the claimant appealed the ruling before the court of appeal. The court changed the appealed ruling and ruled the company should pay legal interest as well.
