KCC 909/2004
Background
A claimant filed a case against defendants and requested the court to dismiss Kuwait Decision No. 5/2002 of the Council of Civil Service and to dismiss Kuwait Decree No. 84/2002 and make a final settlement for his occupational status in accordance with Kuwait Law No. 53/2001.
The court ruled that Kuwait Decision No. 5/2002 should be dismissed and a final settlement of the claimant's occupational status should be dismissed.
The defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.
Decision
The defendants appealed the ruling before the court of cassation.
During the introduction of the appeal before the court of cassation, the defendant's representative decided to leave the dispute at the appeal.
The court stated Articles 146, 147 and 157 of the Pleadings Law permitted the party who introduced the appeal to leave the dispute and this surrender produces its consequences without the need for the claimant's approval.
The court accepted the leave of the appeal.
