Payment of Salaries – Legal Representation – Attending a Court Session – Registration
A case involved a dispute between an employee and a bank over the payment of his salaries.
Background
An employee filed a case against a bank requesting that the court order the bank to pay his salaries.
The court ruled that the bank pay the employee 24230.394 Dinars.
The employee and bank appealed and the appeal court amended the ruling amount.
The employee appealed by cassation.
Decision
Before the cassation court the employee argued that the lawyer representing the bank had attended the court session, however, her name had not been registered as attending.
The court held that this argument was invalid as the lawyer had attended the session but did not make any defence.
The court therefore dismissed the appeal.
