Background

A claimant filed a case against defendants requesting that the court dismiss a decision and Decree No. 84/2002, and make a settlement for his status under Kuwait Law No. 53/2001.

The court ruled that the mentioned decision be dismissed and that the settlement also be dismissed.

The defendants appealed and the appeal court upheld the ruling.

The defendants appealed by cassation.

Decision

Before the cassation court the defendants argued that the ruling had erred in the application of law as the court had established its ruling based on the claimant's case being a settlement case which should not be restricted by deadlines and procedures, however, the case was a cancellation case.

The court held that this argument was invalid as the appeal made by the defendants only fulfilled their theoretical interest.

The court therefore dismissed the appeal.
