KCC 84/2005 issued on 29/1/2006
The initial dispute involved a case by some claimants who had not been paid the full amount for consultancy services and a counter claim by the company that an advanced payment should be returned. A key point was whether the court's jurisdiction in one case could be ruled as not existing while the ruling on returning the advance was made.
Background
Some claimants filed a case against a company before the court. They requested the court to order the company to pay them an amount of money. The claimants said that they had provided consulting services to the company but it had failed to pay them the remaining value of contract.
The legal representative of the company filed a case against the claimants. He requested the court dismiss the claimants' case and order them to pay the advanced payment they had received.
The court dismissed the claimants' case and ruled that the claimant should pay the company the payment they had received in advance.
