KCC 845/2005/1

This case involved money owned to an employee who had finished working for an employer. The court had the right to use the evidence to rule whether deductions should be made from the money owed.

Background

A claimant filed a case against two defendants and requested the court order them to pay an amount of money. The claimant stated she had finished working for the first defendant and he stills owed her money.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the first defendant should pay the claimant 17848.500 Dinars.

Decision

The first defendant appealed the ruling before the court of cassation and stated in her grounds of appeal that the ruling had erred in the application of law because the expert had ignored the calculation of the value of a guarantee and maintenance and had not deducted this value from the claimant's dues.

The court stated this argument was invalid because the court had the authority to consider all aspects of the case and evaluate its evidences in order to establish its ruling.

The court dismissed the appeal.
