KCC 720/2005

This case involved a request to validate rights to settle occupational and financial status. It was wrongly argued the case should not have been rejected as the decision had not changed the legal position.

Background

A claimant filed a case against the defendants and requested the court to validate their right in settling their occupational and financial status according to the decision of the civil service council No. 10/2003.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The claimant appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law and that they had filed the case before Kuwait Decision No. 14/2003 is issued. The claimant stated they filed their case in order to settle their occupational status and that the administrative authority in this regard was restricted.
