Background

An employee filed a case against a company requesting that the court order the company to pay his salaries.

The court ruled that the company pay the employee 2293.809 Dinars.

The company appealed and the appeal court ruled that the company pay the employee 88.864 Dinars.

The employee appealed by cassation.

Decision

Before the cassation court the employee argued that the ruling had contradicted material documentary evidence as the court had established its ruling on the employee not deserving the value of overtime hours, however, he had provided the court with documents which confirmed he had worked overtime hours.

The court held that this argument was valid and repealed the ruling.
