KCC 663/2005

This case involved a request by an individual that a civil service decision and a decree be dismissed. They also requested a settlement of their status. Although the court ruled the decision should be dismissed they also ruled the settlement should be dismissed too. The defendants decided to leave the dispute and the court and claimant accepted that.

Background

A claimant filed a case against the defendants and requested the court to dismiss the decision of the civil service council No. 5 and dismiss Kuwait Decree No. 84/2002. The claimant also requested the court make a final settlement of their status in accordance with Kuwait Law No. 53/2001.

The court ruled that this decision should be dismissed and a settlement made for the claimant should also be dismissed.

The defendants appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The defendants appealed the ruling before the court of cassation.

The defendants then decided to leave the dispute and the representative of the claimant accepted this action.

The court accepted the leave.
