KCC 64/2004

A case involved a dispute between an employee and a company over the payment of her salaries.

Background

An employee filed a case against a company requesting that the court order the company to pay her salaries after she had been dismissed from her job.

The court rejected the case.

The employee appealed and the appeal court ruled that the company pay the employee 614.327 Dinars.

The company appealed by cassation.

Decision

Before the cassation court the company argued that the ruling had erred in the application of law as it had dismissed the employee for repeated absence and thus did not deserve severance pay.

The court held that this argument was invalid as the company had introduced this defence for the first time before the cassation court.

The court therefore dismissed the appeal.
