An employee made a claim for their dues. It was wrongly argued the case had been settled. However, the settlement had not included an early retirement salary.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay his dues. The department referred the case to the court.

The court rejected the case.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had violated the law and that he had maintained before the court that the settlement document the company provided did not include an early retirement salary.

The court stated this argument was valid because the case documents revealed that the settlement document the company issued for the employee did not include an early retirement salary.

The court repealed the ruling.
