KCC 604/2004
Background
A claimant filed a case against two defendants and requested the court to validate his right to change his sponsor. The claimant stated that he had finished working with a previous sponsor and wanted to move to another one but his request had been rejected.
The court ruled the claimant had the right to change sponsor.
The defendant appealed the ruling before the court of appeal. The court stopped the case for one month.
Decision
The defendant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and stated that residence of the claimant in Kuwait did not fall under the court's mandate.
The court stated this argument was invalid because the appealed ruling had considered the appeal not the subject of the case.
The court dismissed the appeal.
