This case involved a claim by a company for money due to it under a contract. The contract had been cancelled but the Health Ministry had deducted money because it had the right to impose fines. However, when it came to amounts due under a contract the Ministry was expected to claim compensation in the regular way.
Background
A company filed a case against a defendant and requested the court to order the Ministry of Health to pay their remaining dues.
The court ruled that the company had no right to receive 1187.020 Dinars and referred the case to the committee of experts in the Ministry of Justice and then rejected the case.
The company appealed the ruling before the court of appeal. The court upheld the first ruling and changed the second ruling and ruled that the Ministry of Health should pay the company 6360 Dinars.
