Administrative Decision – Administrative Law – Occupational Status – Employee – Final Settlement – Executable conditions
This case involved a request for the validation of an employee's right to make a final settlement. At appeal it was argued the court had mistakenly believed his case was intended to dismiss the administrative decision when this decision met all conditions to make it executable. This was irrelevant as these procedures were just a preparation which did not in itself complete the application components for the administrative decision.
Background
A claimant filed a case against the defendants and requested the court to validate his right to make a final settlement on his occupational status in accordance with the Council of Civil Service No. 10/2003.
The court rejected the case.
The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
