KCC 456/2005

A claimant asked the court to validate his right to make a final settlement on his occupational status. The claimant appealed on the basis that he had provided evidence the court had ignored and it had acted as if he intended to dismiss the administrative decision. The court stated this argument was invalid because the court had established its ruling based on the fact that the procedures were just a preparation which did not in itself complete the administrative decision.

Background

A claimant filed a case against the defendants and requested the court to validate his right to make a final settlement regarding his occupational status in accordance with the Council of Civil Service No. 10/2003.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.
