KCC 452/2005

This case involved a request to validate the right to make a settlement on a claimant's occupational and financial status. It was argued the case had been filed before a decision had been issued. This was invalid as the legal position had not changed.

Background

A claimant filed a case against the defendants and requested the court to validate their right in settling their occupational and financial status according to the decision of the civil service council No. 10/2003.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The claimant appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law and stated that he had filed the case before Kuwait Decision No. 14/2003 was issued. The claimant stated they had filed their case in order to settle their occupational status and that the administrative authority in this regard was restricted.
