This case involved the calculation of severance pay for an employee who had been employed around the period of the Iraqi invasion.

Background

An employee made a complaint against a company and requested the Labour Department to order the company to pay his dues. The department referred the case to the court.

The court ruled that the company should pay the employee 19866.642 Dinars.

The employee and the company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.

The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and the court had first ruled that he should receive the severance pay for the employment period after the Iraqi occupation of Kuwait and then ruled that he did not deserve the severance pay for the whole period before the occupation.

The court stated this argument was valid.

The court repealed the ruling.
