This case involved the approach which should have been taken to an expert report. This included the numbers of experts required and the details of those experts which should have been included in the report.

Background

The court of cassation repealed a ruling in the interest of a company and then referred an employee to a medical committee. The committee provided the court with its report.

Decision

The court stated it could not establish its ruling based on the report because the court had requested the committee be composed of three and not four members. The court stated that the committee had also not revealed the names of the doctors and their signatures on the report.

The court ruled assigned a different committee composed of three members to consider the medical case of the employee.
