Payment of Salaries – Quorum – Right to Appeal
A case involved a dispute between an employee and a company over the payment of his salaries.
Background
An employee filed a case against a company requesting that the court order the company to pay his salaries.
The court ruled that the company pay the employee 3096.91 Dinars.
The company appealed and the appeal court ruled that the company had no right to appeal due to the lack of quorum.
The company appealed by cassation.
Decision
The cassation court raised the issues relating to the general system and stated that the value of the requests of the employee exceeded 5000 Dinars and thus the company had the right to appeal the ruling.
The court therefore repealed the ruling.
