KCC 287/2004

This case involved a claim by an employee for unpaid dues. The court was wrong to reject this case when the employee had followed the correct procedures when filing it.

Background

An employee made a complaint against a company and requested the Labour Department to order the employee to pay his dues. The department referred the case to the court.

The court rejected the case.

The employee appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The employee appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation because he had made a complaint before the Labour Department and the manager came to the department and endorsed the working relationship.

The court stated this argument was valid because the case documents revealed that the employee had followed the legal procedures in filing his case.

The court repealed the ruling.
