Background

A claimant filed a case against defendants requesting that the court dismiss a civil service decision and Decree No. 84/2002, and settle his occupational status under Kuwait Law No. 53/2001.

The court ruled that the civil service decision be dismissed.

The defendants appealed and the appeal court upheld the ruling.

The defendants appealed by cassation.

Decision

During the consideration of the appeal, the representative of the administrative body requested that the claimant leave the dispute. The representative of the claimant accepted and left the dispute.

The court of cassation stated that the party who brings the appeal has the right to leave the dispute during the consideration of the case under Articles 57, 99, 146, 147 and 157 of the Kuwait Pleadings Law, Kuwait Law No. 38/1980.

The court therefore accepted the leave.
