KCC 258/2005

This case involved a claim to validate the right to settle the claimant's occupational and financial status according to an administrative decision. The case was rejected and the claimant tried to claim this should not have happened as they had filed their case before the decision came into force. This was irrelevant as the decision had not changed the legal position.

Background

A claimant filed a case against the defendants and requested the court to validate their right to settle their occupational and financial status according to Kuwait Administrative Decision No. 10/2003.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The claimant appealed the ruling before the court of cassation and stated in their grounds of appeal that the ruling had erred in the application of law and that they had filed the case before Kuwait Administrative Decision No. 14/2003 was issued. The claimant stated they had filed their case in order to settle their occupational status and the administrative authority in was restricted on this regard.
