KCC 219/2005

This case involved a decision which had prevented a license from being issued for a private school. It was wrongly argued the court had failed to consider the evidence. This was not the case as the ruling had been issued on a legal basis.

The claimant appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and the court upheld the elementary ruling without considering the documents he had provided to the court.

The court stated this argument was invalid because the ruling had been established on a legal basis.

The court dismissed the appeal.
