Background
A claimant filed a case against a defendant and requested the court to order the defendant to pay 5001 Dinars in compensation. The claimant stated he had been injured during military training.
The court ruled that the defendant should pay the claimant 5001 Dinars.
The defendant appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the case.
Decision
The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had erred in the application of law and that the court should have referred him to a medical committee when it abandoned the appealed ruling in order to determine the disability rate. The claimant stated his request for temporary compensation had a legal basis therefore.
The court stated this argument was valid and because the request of the claimant was for temporary compensation until the recovery of his medical case.
