KCC 144/2006

The defendant appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law and that it maintained before the court that the case should be rejected because the claimant had failed to make her plea within the legal deadline but the court had ignored this argument.

The court stated this argument was valid because the case documents revealed that the claimant had failed to make her plea to the committee of pleas within 30 days.

The court repealed the ruling.
