KCC 918/2003

The original dispute involved a request for an expert to be appointed to calculate money owed. An appeal was wrongly dismissed because the company had not been informed of it. This was incorrect as the correct appeal and notification procedure had been followed.

Background

A claimant filed a case against a company and requested the court to appoint an expert in order to calculate the amounts of money he had deposited with a company and the remaining amounts he deserved and order the company to pay accordingly.

The court rejected the case.

The claimant appealed the ruling before the court of appeal. The court dismissed the appeal because the company had not been informed about the appeal.

Decision

The claimant appealed the ruling before the court of cassation and stated in his grounds of appeal that the ruling had contradictions of material documentary evidence and the company had been informed within the legal deadline.
