Rent – Rent Department – Request to Demolish Building – Rented Land – Compensation
The original dispute involved a request for compensation after a landlord had requested his tenant demolish a building it was claimed did not have permission to be built and a request for an increase in rent. The key issue in this case was that an appeal could not be taken as the decision to increase the had been made by the Rent Division of the Court
Background
A tenant of a piece of land filed a case (Case Number: 23/2001) requesting compensation for the building he constructed on the land. The tenant claimed on 01/10/1991 he had rented the land from the landlord (one of the respondents to this claim) and agreed he would use it to build a restaurant. However, another party (the second respondent to this claim) filed a case (Case Number 714/2000) requesting an increase in the rent payment. Therefore, the tenant filed the case and requested that the first and second respondents pay him jointly 57716,800 Dinars in line with an expert report. The requested amount was equivalent to the value of the building he had constructed on the land.
