Road Traffic Accident – Compensation – Employer’s Liability - Appeal
This case involved a claim filed by a company against two defendants after they had paid the owner of a car compensation after it had been damaged in a road traffic accident. The first defendant appealed because the second defendant was responsible for the accident but the case against him had been abandoned. This was irrelevant as the second defendant had been working for the first defendant at the time of the accident and had not intended to cause damage.
Background
A company filed a case against two defendants and requested the court order them to pay 5460 Dinars. The company stated they had paid this amount to the owner of a car as compensation for damage to the car.
The court ruled the defendants should pay the company 1400 Dinars.
The company and the defendants appealed the ruling before the court of appeal. The court abandoned the appealed ruling on the second defendant and rejected the case against him.
