Compensation – Contradictory Defence – Failing to State Fault of Ruling
A case involved a dispute between a claimant and defendants over the payment of an amount of money and compensation.
Background
A claimant filed a case against two defendants requesting that the court order them to pay an amount of money and compensation.
The court ruled that the defendants pay the claimant 13000 Dinars and USD 3000 in compensation.
The claimant and defendants appealed and the appeal court abandoned the ruling and rejected the case.
The claimant appealed by cassation.
Decision
Before the cassation court the claimant argued that the ruling had insufficient evidence of causation as the court had stated that her defence was contradictory.
The court held that this argument was invalid as the claimant had failed to state the fault of the ruling she was appealing.
The court therefore dismissed the appeal.
