KCC 756/2003

This case involved a request to overturn a decision by the Deputy Minister of Islamic Awqaf and order specific copies of the Quran not to be circulated. A reconciliation agreement was drawn up and this should be considered an executive bond.

Background

Two claimants filed a case against defendants and requested the court to dismiss a decision of Deputy Minister of Islamic Awqaf (second defendant) and order the defendants to stop circulating a specific copy of the Quran.

The court rejected the case.

The claimants appealed the ruling before the court of appeal. The court abandoned the appealed ruling and ruled the decision should be dismissed and that the defendants should stop circulating this copy of Quran.

The defendants appealed the ruling before the court of cassation.

Decision

The second defendant requested the court remand the case so he could settle the dispute with the claimants through reconciliation and attached his request with the reconciliation agreement.

The court stated the condition of the reconciliation agreement between the two parties did not violate the general system and so the request should be accepted in accordance with Article 73 of the Pleadings Law.
