KCC 6/2004

A case involved a dispute between a company and two companies over the payment of compensation for one of its employees.

Background

A company filed a case against two companies requesting that the court order them to pay an amount of money. The company stated that it had agreed with the first company to do contracting work and one of its employees had been injured during work. The company stated that it had filed a case against the two companies and the court ruled that it should pay compensation to the employee at the time. The company argued that it had the right to claim the value of compensation back from the two companies.

The court rejected the case.

The company appealed and the appeal court upheld the ruling.

The company appealed by cassation.

Decision

The court of cassation determined a session to consider the case and requested that the two companies provide the court with the insurance document.

The court stated that the insurance document stipulated that the insurance should cover employees in certain local markets and did not include accidents that take place somewhere else. The court stated that the employee had been injured somewhere else.
