KCC 563/2004

A case involved a dispute between heirs of an employee and defendants over the payment of compensation for the death of their father.

Background

The heirs of an employee filed a case against three defendants requesting that the court order them to pay the employee's salaries and 10000 Dinars in blood money and 10000 Dinars in compensation for the death of their father.

The third defendant filed a case against the first and second defendants requesting that the court order them to pay 5001 Dinars in temporary compensation.

The court held it had no mandate to consider the case and referred it to the plenary court.

The first defendant added an insurance company to the case requesting that the court order it to pay the value of compensation.

The court rejected the request made by the first defendant and ruled that the defendants pay the heirs 18500 Dinars and the first and second defendants pay the third defendant 5001 Dinars.

The parties appealed and the appeal court upheld the ruling.

The first defendant appealed by cassation.
