KCC 447/2004

This case involved a request for an arbitration ruling to be dismissed by the court. In order to make an appeal the appeal documentation should include the reasons for the appeal.

Background

A company filed a case against two defendants and requested the court to dismiss a ruling issued by an arbitration committee.

The court rejected the case.

The company appealed the ruling before the court of appeal. The court upheld the appealed ruling.

Decision

The company appealed the ruling before the court of cassation and stated in its grounds of appeal that the ruling had erred in the application of law and had insufficient evidence of causation.

The court stated this argument was invalid because Article 153 of the Civil and Commercial Pleadings Law stipulated that the appeal document should include the reasons behind the appeal of the ruling. The court stated the court had not determined the reasons for the appeal.

The court dismissed the appeal.
