Background

A claimant filed a case against an insurance company and requested the court to order the defendant to pay them an amount of money and legal interest as compensation for damage which had resulted from fire.

The court ruled the insurance company should pay the claimant 140000 Dinars.

The insurance company appealed the ruling before the court of appeal. The court abandoned the appealed ruling.

Decision

The claimant appealed the ruling before the court of cassation and stated in her grounds of appeal that the ruling had erred in the application of law and stated the court had established its ruling based on an expert report of expert although she had objected to the conclusions of the report.

The court stated this argument was invalid because the court had concluded that the claimant had violated the conditions of insurance contract and so the ruling complied with the law.

The court dismissed the appeal.
