Background
A claimant filed a case against a defendant requesting that the court order it to pay half her salary including all allowances.
The court held that the request regards payment of half of her salary be rejected due to the statute of limitations.
The claimant and defendant appealed and the appeal court ruled that the defendant pay half the claimant's salary.
The defendant appealed by cassation.
Decision
Before the cassation court the defendant argued that the ruling had erred in the application of law as the ruling had violated Article 21 of the Kuwait Civil Service Law.
The court held that this argument was invalid as the claimant did not know that she had the right to receive half her salary during her holiday period and the case documents included no evidence that proved otherwise.
The court therefore dismissed the appeal.
