KCC 341/2003

This case involved money under a contract for the sale of goods. The committee of expert's report apparently concluded the second defendant was obliged to pay. Articles 201 and 203 of the Civil Law stipulated that the two parties to the contract should commit to their obligations and that the contract did not result in commitment by a third party.

Background

A claimant filed a case against a company and requested the court to order the company to pay him an amount of money and legal interest. The claimant stated his company supplied the company with goods but they still owed the amount.

The company added another company to the case and requested the court order the company to pay the amount.

The second company filed a case against the first company and requested the court to order it to pay the amount.

The court ruled that the first company should pay the claimant 10477 Dinars and legal interest. The court ruled the first company should pay the second defendant 18179.494 Dinars and legal interest of 7%.

The first company appealed the ruling before the court of appeal. The court abandoned the appealed ruling and rejected the two cases.
