KCC 324/2004
Background
A claimant filed a case against a defendant requesting that the court order the defendant to pay his salaries.
The court rejected the case.
The claimant appealed and the appeal court upheld the ruling.
The claimant appealed by cassation.
Decision
Before the cassation court the claimant argued that the ruling had erred in the application of law and had insufficient evidence of causation as the court had ignored the documents he provided which confirmed he had treated patients during the period in question.
The court held that this argument was invalid as the Council of Ministers had issued a decision which considered all working contracts dismissed during the Iraqi occupation of Kuwait. The court also stated that the claimant had failed to prove that he worked during the mentioned period.
The court therefore dismissed the appeal.
